Wolff Construction LLC (dba Wolff Roofing) ("Company", "We", "Us", "Our") welcomes you. These Terms & Conditions ("Terms") govern your use of our website (https://wolff-roofing.com/) and the construction, roofing, and exterior services we provide. By scheduling an estimate, signing a contract, or using our services, you ("Customer", "Client", "You") agree to be bound by these Terms.

1. Scope of Services

Wolff Construction is a licensed general contractor in the State of Utah. We provide commercial roofing, siding, window, gutter services, and general exterior remodeling.

  • Estimates: All estimates are valid for 30 days from the date of issuance. After 30 days, prices are subject to change due to material cost fluctuations.
  • Contract: A binding contract exists only when a proposal is signed by both the Customer and an authorized representative of Wolff Construction.
  • Change Orders: Any alteration or deviation from the original scope of work involving extra costs will be executed only upon a written "Change Order" signed by both parties.

2. Payment Terms

  • Deposit: A deposit (typically 50%) is required to schedule your project and order materials.
  • Final Payment: The remaining balance is due immediately upon substantial completion of the project.
  • Late Fees: Invoices not paid within 10 days of completion may be subject to a late fee of 1.5% per month (18% APR) or the maximum allowed by Utah law.
  • Credit Cards: We accept major credit cards. A processing fee of up to 3% may apply to credit card transactions.

3. Mechanics Lien Warning (Utah Code)

NOTICE TO OWNER: Under Utah law, contractors, subcontractors, and material suppliers who provide services or goods to improve your property have the right to place a lien on your property if they are not paid.

  • Our Commitment: Wolff Construction commits to paying all suppliers and subcontractors associated with your project promptly upon receipt of your payment.
  • Lien Waivers: Upon final payment, we will provide a full lien waiver upon request, certifying that all labor and materials have been paid in full.

4. Warranties & Guarantees

Workmanship Warranty: Wolff Construction provides a standard Workmanship Warranty (length specified in your individual contract, typically 2-10 years depending on the service) covering defects. This warranty is separate from manufacturer warranties.

Manufacturer Warranty: Materials (shingles, TPO membranes, windows, siding) are covered exclusively by the manufacturer’s warranty. Wolff Construction will assist in filing claims but is not liable for material defects.

Exclusions: Our warranty does not cover damage caused by:

  • Acts of God (severe storms, lightning, earthquakes, hail).
  • Foot traffic by non-Wolff personnel (e.g., HVAC techs, holiday light installers).
  • Lack of homeowner maintenance (e.g., clogged gutters causing ice dams).

5. Site Conditions & Access

  • Access: You agree to provide our crew with reasonable access to the property, including driveway space for dumpsters and material trucks.
  • Landscaping: While we take our "Peace of Mind" precautions (tarping and magnetic sweeps), minor stress to lawns or landscaping is possible during heavy construction. We are not responsible for minor turf damage caused by falling debris or foot traffic.
  • Satellite Dishes: We may need to detach satellite dishes to replace roofing. We are not responsible for realigning the signal.

6. "Peace of Mind" Protocols

To ensure your safety and comfort, Wolff Construction agrees to:

  • Provide a portable toilet for crew use on major projects (keeping them out of your home).
  • Perform a daily cleanup of the job site.
  • Conduct a final magnetic sweep for nails.

7. Cancellations

  • Right of Rescission: You may cancel this transaction within three (3) business days from the date of the signed contract without penalty, as provided by federal law.
  • Material Restocking: If you cancel after materials have been ordered (outside the 3-day window), you may be responsible for a restocking fee of up to 25% of the material cost.

8. Dispute Resolution

  • Governing Law: These Terms shall be governed by the laws of the State of Utah.
  • Mediation: In the event of a dispute, both parties agree to attempt mediation in Salt Lake County before pursuing litigation.
  • Legal Fees: If legal action is necessary to collect unpaid balances, the prevailing party shall be entitled to recover reasonable attorney’s fees and court costs.
